Sanctions Proposal against Clariant Ltd

On 2 March 2023, SIX Exchange Regulation AG (SER) has submitted a sanctions proposal to the Sanctions Commission against Clariant Ltd concerning alleged violations of the regulations on financial reporting.

After completion of its investigation, SER has concluded that the 2020 and 2021 IFRS annual financial statements contain misstatements. For this reason SER has submitted a request for a sanction to the Sanctions Commission of SIX Group against Clariant Ltd on 2 March 2023.

The alleged errors relate to the recognition of unjustified provisions in the 2020 IFRS financial statements and insufficient disclosures in connection with the correction of these errors in the 2021 IFRS financial statements.

The proceedings at hand and the respective sanctions proposal submitted on 2 March 2023 are independent of the investigation by SER against Clariant Ltd published on 12 January 2023 for a potential violation of the rules on ad hoc publicity.

No information will be provided while the sanction proceedings are ongoing. SER will inform the public about the outcome of the sanction proceedings.
